ONE TIME USE RESTRICTION, LIABILITY LIMITATIONS AND FINALIZATION OF PURCHASE AGREEMENT
STATEMENT OF DUE DILIGENCE
Due diligence and care has been given in the preparation of these SOLAR DOZENŠ Construction documents. The plans reflect requirements of the 2003 International Residential Code [IRC] and exceed the Model Energy Code requirements. They serve the needs of obtaining permits, cost estimates and financing appraisals in most locales. However, it is the responsibility of the owner/builder to meet all Federal, State or local building, plumbing, mechanical and electrical code requirements, or other requirements such as hazard flood plain, steep slope, earthquake zone earth stability, drainage, or other requirements applicable to the site location.
It is understood that Solar Plans LLC is not a licensed architectural firm.
However, those persons responsible for creating the concept of, and drawing these SOLAR DOZENŠ building plans for Solar Plans LLC are solar and green building consultants and schooled in engineering. Solar Plans LLC has extensive experience in providing quality solar-design residential plans which have been accepted for building permits in the states of New Mexico, Colorado and Oregon.
ONE-TIME USE RESTRICTION
All rights to the original design and original SOLAR DOZENŠ construction documents are the property of Solar Plans LLC. You are purchasing a reproduction strictly for your single family residence project. You are allowed to make copies of the plans only for the purposes inherent with building one home on the specified property. You agree that you shall not use, or permit the use of this reproduction, or any copy of it, for any other purpose whatsoever, without the advance express, written permission of Solar Plans LLC.
With your selection of a SOLAR DOZENŠ home plan and payment of the deposit you agree that the set of plans you will receive are for your one time use in building one residence which is to be located at the address defined on
the site plan page of that specific set of plans. You will need to provide
a property tax number and additional legal descriptive of the property,
all of which will be referenced on the construction documents.
LIABILITY LIMITATIONS-BUILDING PERMIT-REFUND POLICY
The construction documents provided serve the needs of obtaining permits, cost estimates and financing appraisals in most locales. Solar Plans LLC cannot guarantee that you will automatically obtain a building permit since there are factors beyond these construction documents that planning departments review for each individual. No refund requests made to Solar Plans LLC will be honored if a permit is denied because of issues such as site-location (hazard flood plain, steep slope, earthquake zone, ground stability, drainage, or other site-specific requirements), zoning or political reasons. Those are issues beyond the scope of the drawings provided.
In the event that a building permit cannot be obtained because of an issue related directly to the construction documents, Solar Plans LLC will promptly strive to add or adjust any notes or drawings required by your jurisdiction. If Solar Plans LLC determines the scope of changes are outside reasonable parameters you will be entitled to a refund of your purchase price, less a $150.00 handling fee. Solar Plans LLC's Liability for any building permit issue is limited to this remedy.
In the event that you should exercise your right to this remedy, you agree that you shall not use, or permit the use of this reproduction, or any copy of it, for any other purpose whatsoever, without the advance express, written permission of Solar Plans LLC.
LIABILITY LIMITATIONS-SITE CONSTRUCTION LIABILITY-HOLD HARMLESS
Solar Plans LLC has no responsibility for, nor is it involved with the construction, or supervision or control of the material provided or actual construction of the residence for which these plans are provided. You, as the purchaser of a SOLAR DOZENŠ plan agree to hold Solar Plans LLC, or any of its officers, directors, employees or agents harmless for any error of construction or foreseeable consequences thereof, caused by the builder's failure to follow the SOLAR DOZENŠ plan specifications and requirements, or failure to follow trade-standard acceptable building procedures or state, local or federal Code requirements.
FINALIZING PURCHASE
After you review and agree to the one time use agreement and the liability release, your order will be processed securely in PAYPAL, and once payment is submitted successfully you will be returned to our website's thank you page. Solar Plans LLC will contact you within 3 working days to finalize information and begin the process to get one copy of your SOLAR DOZENŠ construction documents delivered to you by first class mail, which is included in the purchase price, or other means of delivery, the additional cost of which is to be paid for by you.
PURCHASER'S AGREEMENT
I HEREBY AGREE TO BE BOUND BY THE FOREGOING STATEMENT, RESTRICTIONS OF USE AND LIMITATION OF LIABILITY STATEMENT AS THE PURCHASER OF A SOLAR DOZENŠ PLAN FROM SOLAR PLANS LLC.
